Legal Eagle. Gucci Sues Guess….Again.

May 8, 2009 • Fashion

As reported by Bloomberg, Gucci Group’s U.S. unit sued Los Angeles-based Guess? Inc. for trademark infringement on Wednesday. Gucci is accusing the apparel company of using a network of wholesale buyers to sell imitations of Gucci’s best-selling designs.

Gucci claims Guess continuously sells knockoffs of Gucci’s “famous” green-red-green stripe designs and interlocking “GG” patterns on footwear, wallets and other accessories. I myself have turned my head a couple of times unable to immediatly figure out if a bag I glanced at was Gucci or Guess and have always wondered how Guess has gotten away with this.

Guess has “replicated entire Gucci product designs, to the point that there appears to be a concerted effort to ‘Gucci-ize’ defendant’s product line,” Gucci alleges.

Gucci is seeking unspecified money damages and a court order barring Guess from using the disputed designs and patterns. Additionally, they  want the items destroyed. This could get interesting.
