J.C.Penney Asks Court to Dismiss Lawsuit
This past Wednesday J.C.Penney Co. asked the court to dismiss a lawsuit that design firm Hudson + Broad filed over their Plexiglas LED square designed for Penney’s “Fair and Square” campaign. Filed on April 25th, the suit stated that there was a breach of contract and misappropriation of trade secrets. The design firm is looking for $40 million – $20 for compensatory damages and another $20 for punitive damages.
In December the firm was asked to create a unique fixture for Penney’s new campaign, with the idea that it would not be misappropriated and bid out to other manufacturers. The company’s original order was 1,800 units for 700 stores, however in the suit it states that on April 3 Hudson + Broad was told Penney’s sourced the fixture elsewhere. Hudson + Broad stated that by spring communication with Penney’s had stopped.
During this time the court did not receive acknowledgment of the lawsuit from Penney’s and due to failure to meet the statutory deadline, the Southern District of New York filed a certificate of default against Penney’s. On Wednesday the company finally responded, asking the court to vacate the certificate of default and dismiss the complaint. Neither were dismissed, meaning that Penney’s will now have a July 27th court date. Meanwhile Hudson + Broad is using YouTube, giving direct messages to Penney’s chief executive officer Ron Johnson and spokeswoman Ellen DeGeneres, in an attempt to communicate with the retailer.
Dolce & Gabbana Launching Luxury Watch Collection
Sorry ladies, this line is for men only. However, what woman doesn’t own a men’s watch or two? Dolce & Gabbana will be unveiling their new men’s line, comprised of 52 models, at Dolce & Gabbana boutiques starting June 18.
The watches, which are Swiss made and designed in-house, include three product lines: the more classic DG7, with bracelets featuring the traditional Fifties mesh Milano chain; the sports-inspired DS5, with COSC-certified chronometers and chronographs that have passed accuracy and precision tests by the Official Swiss Chronometer Testing Institute, and the DG7 Gems, whose dials are embellished with diamonds, rubies, sapphires or emeralds. The watches will retail for upward of $2,500.
Asked for reasons for opting for a men’s line, Dolce said: “We like women with men’s watches, watches are not categorized by a specific gender, perhaps size is more of a differentiating element.” See?
Barneys Pairing with Disney Co. for Holiday Campaign
Barneys New York has finally made a holiday campaign decision: the retailer will be pairing up with Disney Co. for the holiday campaign to create their own merry holiday. Along with using the many aspects of Disney, one highlight will be the fashion film Disney is currently creating with Barneys using “moving art.”
Sources have admitted that the retailer has been speaking to designers, editors, photographers, and other people within the fashion industry to “star” in the holiday film. No one knows for sure who is taking part in this creation, however with the long list of Disney characters and the interesting combination of fashion insiders, it will sure be a festive holiday.
Brioni Launching Sunglasses Line
The luxury firm Brioni recently announced that they will be launching their own collection of hand-crafted Italian sunglasses. Artisans will use metal and horn to create two styles; contemporary aviators along with square aviators. With adjustable arms and frame colors ranging from dark gray to brown and green polarized, the glasses are able to come in fifteen different variations. The sunglasses will be sold at Brioni’s flagship stores beginning in June.
