A judge on Tuesday threw out Todd Oldham's breach of contract lawsuit against Old Navy, his former employer.

Old Navy had hired Oldham as "design creative director" in September of 2007. According to the ruling, both parties had a side plan to enter into a separate licensing deal for a Todd Oldham signature line by October 2008. The negotiations failed and Oldham's L-7 Designs Inc. filed suit against Old Navy the following February, while Old Navy ended their agreement two days later.

U.S. District Court Judge Denny Chin decided that Oldham's suit did not have enough evidence to prove that Old Navy did not have enough faith in the line, even stating that Oldham's L-7 Design was making "extraordinarily high demands."

Oldham said that he will continue to appeal the decision. The judge gave the retailer three days to decide whether it wants to go forward with its counterclaims in the case, including allegations that L-7 breached its own obligations under the collaboration agreement.
